6. TCPA Compliance
Important: You, the User, are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and all other applicable federal and state telemarketing laws and regulations.
When using Fastlane Hub for outbound calling, you acknowledge and agree that:
- Do Not Call (DNC) Lists — You are responsible for maintaining and honoring your own internal DNC lists, as well as the National Do Not Call Registry. You must scrub your calling lists against applicable DNC lists before placing calls.
- Prior Consent — You must obtain all required consents before placing calls, including express written consent for calls using automated dialing systems or prerecorded messages, as required by the TCPA.
- Calling Hours — You must comply with calling hour restrictions. Under federal law, telemarketing calls may not be placed before 8:00 AM or after 9:00 PM in the called party's local time zone. State laws may impose stricter restrictions.
- Abandonment Rate — You must meet the abandonment rate requirements (no more than 3% of answered calls per campaign per 30-day period). Fastlane Hub provides abandonment rate tracking tools, but you are responsible for monitoring and maintaining compliance.
- Caller ID Requirements — You must transmit accurate caller ID information. Calls must display a valid phone number that the called party can use to reach you.
Fastlane Hub provides tools to assist with compliance (DNC list management, abandonment rate tracking, calling hour awareness), but the provision of these tools does not constitute legal advice and does not guarantee compliance. You are responsible for understanding and complying with all applicable laws.
7. Call Recording Disclosure
Fastlane Hub provides an optional call recording feature that can be enabled or disabled in your account settings. When call recording is enabled:
- Automatic Disclosure — Fastlane Hub provides an automatic disclosure announcement at the beginning of recorded calls ("This call may be recorded") when recording is enabled.
- Legal Responsibility — You are solely responsible for ensuring that all parties to a call are informed of the recording in accordance with applicable federal and state laws.
- Consent Laws — The United States has a mix of one-party and two-party (all-party) consent states. In one-party consent states, only one participant needs to be aware of the recording. In two-party consent states (such as California, Florida, Illinois, and others), all parties must consent to being recorded. You must understand and comply with the laws of the jurisdictions in which you operate and in which the called parties are located.
- Storage — Call recordings are stored securely and are accessible through your account. You are responsible for managing and deleting recordings in accordance with your data retention policies and applicable laws.
8. GDPR Compliance
For users who process personal data of individuals in the European Economic Area (EEA) or United Kingdom:
- Data Roles — Under the General Data Protection Regulation (GDPR), you (the User) act as the data controller and Vision Media (Fastlane Hub) acts as a data processor on your behalf.
- Data Processing Agreement — A Data Processing Agreement (DPA) is available upon request. Contact us at kenny@vision-media.fr to request a DPA.
